Agreement to Terms

By accessing or using the KBE AI mobile application or the kbendo.org website (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you disagree with any part of these Terms, you do not have permission to access the Services.

Description of Service

Kuwait Board of Endodontics (“KBE,” “we,” “us,” or “our”) develops and operates the KBE AI mobile application and the kbendo.org website to facilitate academic and clinical communication between residents, faculty members, program directors, and administrators within the endodontics training program, and to provide public information about the Kuwait Board of Endodontics residency program.

• Literature review submissions and evaluations

Eligibility and Account Registration

Eligibility Requirements

To use the KBE AI App, you must:

• Be a current resident, faculty member, or administrator of the Kuwait Board of Endodontics program
• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security and confidentiality of your account credentials

Account Responsibilities

You are responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your password and account information
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your contact information is current and accurate

Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Use
• You provide false or misleading information
• Your account is used for unauthorized or illegal purposes
• You are no longer affiliated with the KBE program
• We believe your actions may cause legal liability or harm to KBE or other users

Acceptable Use Policy

Permitted Uses

You may use the Services to:

• Access educational and clinical resources
• Communicate with faculty and fellow residents
• Submit and review academic work
• Manage patient referrals and clinical cases
• Schedule and track academic activities

Prohibited Activities

You may NOT:

• Share your account credentials with others
• Access or attempt to access another user’s account without authorization
• Upload malicious code, viruses, or harmful content
• Use the Services for any unlawful purpose
• Harass, abuse, or harm other users
• Share patient information outside the Services or with unauthorized individuals
• Attempt to circumvent security measures or access controls
• Use the Services to distribute spam or unsolicited messages
• Reverse engineer, decompile, or disassemble any part of the Services
• Scrape, data mine, or use automated tools to extract data from the Services
• Impersonate another person or entity
• Upload copyrighted material without proper authorization
• Interfere with or disrupt the Services’ functionality

Intellectual Property Rights

Our Rights

All content, features, and functionality of the KBE AI App and the kbendo.org website, including but not limited to:

• Software code and architecture
• Text, graphics, logos, and images
• User interface design
• Trademarks and service marks

are owned by Kuwait Board of Endodontics or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Your Rights

You retain ownership of any original content you create and upload to the App (such as case presentations, literature reviews, or academic submissions).

License Grant

By uploading content to the App, you grant KBE a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content solely for the purposes of:

• Operating and improving the Services
• Providing educational services
• Facilitating academic review and evaluation
• Complying with legal obligations

Patient Privacy and Medical Information

HIPAA and Privacy Compliance

When using the Services to discuss patient cases or referrals:

• You must comply with all applicable privacy laws, including HIPAA (if applicable)
• You must de-identify patient information whenever possible
• You must not share patient identifiable information outside the Services
• You are responsible for obtaining necessary patient consents

Professional Responsibility

You acknowledge that:

• The Services are an educational tool and do not replace professional medical judgment
• Clinical decisions remain your professional responsibility
• KBE is not liable for clinical outcomes or medical decisions made using information from the Services
• You must verify all clinical information independently

Disclaimers and Limitation of Liability

“As Is” Service

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties regarding accuracy, reliability, or completeness of information
• Warranties that the Services will be uninterrupted, secure, or error-free

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KBE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or opportunities
• Medical malpractice or clinical errors
• Damages resulting from unauthorized access to your account
• Damages resulting from Services downtime or technical issues
• Any damages exceeding the amount you paid to use the Services (if applicable)

Medical Disclaimer

The Services are for educational and administrative purposes only. They do not provide medical advice, diagnosis, or treatment. Always seek the advice of qualified healthcare providers with questions regarding medical conditions.

Indemnification

You agree to indemnify, defend, and hold harmless KBE, its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your clinical decisions or professional conduct
• Content you submit to the Services

Data Security and Backup

Our Responsibilities

We implement reasonable security measures to protect your data, including:

• Encryption of data in transit and at rest
• Role-based access controls
• Regular security audits
• Secure authentication mechanisms

Your Responsibilities

You are responsible for:

• Maintaining backup copies of important data
• Using strong passwords and enabling available security features
• Reporting security vulnerabilities or breaches immediately

No Guarantee

While we take security seriously, we cannot guarantee absolute security. You use the Services at your own risk.

Modifications to the Services and Terms

Right to Modify

We reserve the right to:

• Modify, suspend, or discontinue any feature of the Services at any time
• Update these Terms of Use with or without notice
• Change pricing or introduce fees for App features

Notification of Changes

For material changes to these Terms, we will:

• Post the updated Terms in the App and on the Website with a new “Last Updated” date
• Notify you through the App or via email
• Require acceptance of new Terms for continued use (for significant changes)

Continued Use

Your continued use of the Services after changes constitutes acceptance of the modified Terms.

Third-Party Services and Links

The Services may contain links to third-party websites or integrate with third-party services. We are not responsible for:

• The content, accuracy, or practices of third-party sites
• Privacy policies of third-party services
• Damages or losses caused by third-party services

Your use of third-party services is at your own risk and subject to their terms and policies.

Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait, without regard to conflict of law principles.

Dispute Resolution

In the event of any dispute arising from these Terms or use of the Services:

• Informal Resolution: Parties agree to first attempt informal resolution by contacting info@kbendo.org
• Mediation: If informal resolution fails, parties agree to mediation before pursuing litigation
• Jurisdiction: Any legal action shall be brought in the courts of Kuwait

Exceptions

Nothing in these Terms limits our right to seek injunctive relief or protect our intellectual property rights.

App Store and Distribution Platforms

The KBE AI mobile application is made available through Apple’s App Store (iOS) and Google Play (Android). Your use of the App is also subject to the terms and conditions of the applicable distribution platform.

Apple App Store (iOS)

If you downloaded the KBE AI App from the Apple App Store, the following additional terms apply:

• These Terms constitute an agreement between you and Kuwait Board of Endodontics only, and not with Apple Inc. Apple is not a party to these Terms.
• KBE, not Apple, is solely responsible for the KBE AI App and its content, including maintenance, support services, warranties, and any claims relating to the App (including product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation).
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including intellectual property infringement claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
• You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Google Play (Android)

If you downloaded the KBE AI App from Google Play, the following additional terms apply:

• These Terms constitute an agreement between you and Kuwait Board of Endodontics only, and not with Google LLC or any of its affiliates. Google is not a party to these Terms and has no responsibility for the App or its content.
• Your use of the App is also subject to the Google Play Terms of Service.
• You may request deletion of your account and personal data at any time by following the process described on our Data Deletion page.

Privacy and Data Deletion

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

You have the right to request deletion of your account and personal data. For details on what data is deleted, what may be retained, and the processing timeline, visit our Data Deletion Request page or email admin@kbendo.org.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KBE regarding the use of the Services and supersede any prior agreements.

Acknowledgment

BY USING THE KBE AI APP OR THE KBENDO.ORG WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
